E-STATEMENT DISCLOSURE AND USER AGREEMENT 


 

Statement Service Agreement and Disclosure (Electronic Statements and Notifications)
This Agreement governs the receipt of your periodic account statements for those accounts that you designate (“Designated Accounts”) through The Necedah Bank Online Banking. In addition, you may receive most disclosures and notices on your Designated Accounts through the same web-based electronic service instead of by regular mail (“Disclosures”). These Disclosures may include:
* Online Banking Agreement and any amendments thereto * Monthly account statements * Deposit account disclosures * Lending disclosures * Privacy Policy * Change in Terms Notices * Notice of fee changes * Fee Schedules * Other written notices required by law

 

Definitions

As used in this Agreement, the words “we”, “our”, “us”, and “Bank” mean The Necedah Bank.  “You”, “your”, and “Customer” refer to the account holder(s) authorized to receive e-Statements under this Agreement.  “Account” or “accounts” mean your accounts at the Bank.  “Business Days” mean Monday through Friday, excluding Federal Reserve holidays or other days that banks are legally closed.

 

Authorization

By enrolling in the e-Statement service through the Bank’s Online Banking Service, you are authorizing the Bank to provide notices and to deliver statements by electronic means for all accounts enrolled now and in the future.  You understand and agree that by requesting electronic delivery, you will NOT receive statements in paper form delivered by United States Postal Service mail.  You agree that electronic delivery will satisfy the Bank’s requirement to provide you a periodic statement of your account(s).  Your consent shall remain valid until such time as you exercise your right to revoke this consent.  We reserve the right to discontinue this service at any time.  Should your e-Statement service be discontinued, the Bank will resume the paper delivery of your statement.

 

Technical Requirements for Using E-Statements

To access and retain your e-Statements you will need the following:

 

(a)   A personal computer or other device capable of accessing the Internet.  Your access to this page verifies that your system/device meets these requirements.

(b)   Enrollment The Necedah Bank’s Online Banking Service

(c)    An Internet web browser which is capable of supporting 128-bit SSL encrypted communications, such as Internet Explorer 8 or higher, Mozilla Firefox, Google Chrome or Safari 5.1.7 or higher

(d)   Adobe Acrobat Reader versions 9.x or 10.x to open and view e-Statements (available for downloading at http://www.Adobe.com/products).

(e)   Access to a printer or the ability to download and store information in order to keep copies of your e-Statements

 

Access to Your E-Statements

 

After signing into Online Banking, you will be provided access to your e-Statements through the following menu items: Accounts > Documents. You will need to choose the account, Document Type (e-statements), and search the date range for applicable statement. Access to your e-Statements will be provided for a period of twelve (12) months from the date of each e-Statements

 

An e-mail notification will be sent to you at the address provided to let you know when your e-Statement is available for viewing.  It is your responsibility to review each statement provided through the Online Banking Service. 

 

If your e-mail notification is returned as undeliverable, an attempt will be made to contact you.  If contact cannot be made, a paper statement will be sent to you through the United States Postal Service mail for the current and future statement cycles, and your e-Statement service terminated. 

 

You are responsible for retention of your e-Statements and may find it advisable to print or download e-Statements for permanent retention.  In the event of equipment failure and you are unable to retrieve your e-Statement, you may obtain a paper copy of any statement by contacting us at 608-565-2296 or by sending an e-mail through the secure mail link in Online Banking or a general e-mail addressed to contactus@thenecedahbank.com.

 

 

Your Responsibility To Notify Us Regarding Errors, Irregularities, or Unauthorized Access

You must promptly review your e-Statements and any accompanying items.  Notify us immediately of any suspected error, alteration, or other irregularity, (a) with your e-Statements; or (b) with your account, including unauthorized access.  Telephoning us immediately is the best way to keep your losses down, although you may also need to notify us in writing to preserve your rights.  Notification of suspected errors, alterations, or other irregularity within your e-Statement must be given within sixty (60) calendar days of the e-Statements in which the suspect item appears.  This time period begins on the e-Statement e-mail notification date, regardless of when you access and/or review your e-Statement.

 

Your Responsibility To Update Your Electronic Contact Information

You are responsible for notifying us of any e-mail address changes.  Notification of any e-mail changes should be received five (5) Business Days before the end of your normal statement cycle.  You may change your e-mail address by updating the address under the “Profile” tab in your Online Banking account, calling Customer Service at 608-565-2296, or contacting us through the secure mail link in Online Banking.

 

Username and Password Security

Your Username and password are used to access Online Banking Services.  For security purposes, you are required to change your password every 12 months. You are responsible for keeping your Username, password, responses to security questions, account numbers, and other account data confidential.  You further understand and agree to notify the Bank immediately if your Username and password should become compromised or known to individuals who are not authorized by you. 

 

Joint Accounts

If your account(s) is/are owned jointly with another person, either one of you may consent to receive or cancel online e-Statement service.  Such consent to access online e-Statements shall apply to all owners.  A notification e-mail to one owner of a joint account is considered notice to all owners.

 

Cancellation Rights

You retain the right to withdraw your consent for electronic delivery of periodic statements.  You may withdraw your consent at any time by giving us notice at least five (5) Business Days before the end of your normal statement cycle.  Contact us by calling 608-565-2296, or by e-mail through the secure mail link in Online Banking or in writing to The Necedah Bank,

 Attn:  Customer Service, P.O. Box 490, Necedah, WI  54646.  Once you have withdrawn your consent, we will discontinue the e-Statement delivery service and paper statements will be resumed.  The cancellation of the e-Statement delivery service in no way affects the validity or legal effect of all e-Statements which have been previously delivered electronically.

 

The Bank reserves its right to terminate this E-Statement Disclosure and User Agreement and your access to the e-Statement service, in whole or in part, at any time. 

 

Disclaimer of Warranty and Limitation of Liability

We will use our best efforts to deliver your e-Statements in a timely manner and in accordance with any applicable time required by law.  However, we shall incur no liability if we are unable to deliver your e-Statements because of circumstances including, but not limited to, the following:  (a) Our Online Banking Service is not functioning properly, and you know or have been advised by us of the malfunction; (b) Your equipment or Internet access is not working properly; (c) Internet service is interrupted (e.g. due to traffic or other disruptions); or (d) Circumstances beyond our control (including, but not limited to, fire, flood, interruption in telephone service or other communication lines, interference from an outside force, legal restriction or delays in mail service) which prevent proper delivery, and we have taken reasonable precautions within our control to avoid such circumstances. 

 

We make no warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose in connection with e-Statements provided to you under the Agreement.  We do not and cannot warrant that the Online Banking Service and e-Statement service will operate without error or that the Online Banking Service and e-Statement service will be available at all times.  Except as specifically provided in this Agreement or otherwise required by law, you agree that our officers, directors, employees, agents and contractors are not liable for any indirect, incidental, special or consequential damages under or by reason of any services or products provided under the Agreement or by reason of your use of the Online Banking Service and e-Statement service, including loss of profits, revenue, data or use by you or any third party, whether in an action in contract or tort or based on a warranty or any other legal theory.

 

Agreement Regarding Your Use of E-Statements

You agree not to alter or use the e-Statements for any unauthorized, fraudulent, or other illegal purpose.  By applying for and accessing e-Statements, you agree to be bound by any and all laws, rules, regulations and official issuances applicable to e-Statements now existing or which may hereafter be enacted, issued, or enforced, as well as such other terms and conditions governing the use of other facilities, benefits or services that the Bank may from time to time make available to you in connection with e-Statements.  This Agreement is subject to all applicable laws and regulations, recognized banking customs, the Bank’s fee schedule in effect at the time an Online Banking service is used, and other requirements as set forth in “General Account Disclosures”, as amended from time to time.  In addition, this Agreement shall be deemed null and void upon the closing of an account and all Online Banking Services established for and available to such account shall be immediately terminated.

 

Miscellaneous

This Agreement constitutes the entire agreement of the parties with respect to the e-Statement service.  This Agreement will be governed by and construed in accordance with the Electronic Signatures in Global and National Commerce Act.  If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, the parties agree that the court should endeavor to give effect to the parties intentions as reflected in this Agreement, and the other provisions of the Agreement shall remain in full force and effect.  Any delay or omission by The Necedah Bank to exercise any rights under this Agreement shall not be construed to be a waiver thereof.  You may not assign this Agreement or any of the rights hereunder without the Bank’s prior consent.
